What happens when a visa officer denies an application for sponsorship or a permanent resident’s application for citizenship? What is the next step if your refugee claim is rejected?
Based on the ground, one may wish to dispute the decision. There are two main ways for this purpose:
- To appeal
- To seek leave for a judicial review
If your specific situation grants you the right of appeal, you have the right to have:
- A counsel
- An interpreter
- The right to be heard
- A witness(es)
The Immigration Division (ID) decisions may be appealed to the Immigration Appeal Division (IAD) and the decisions from the Refugee Protection Division (RPD) can be appealed to the Refugee Appeal Division (RAD).
