VISITOR CLASS

Visitor class applies to the following foreign nationals:

  • Travellers
  • Tourists
  • Vacationers
  • Visitors of friends/ family members
  • Students
  • Workers

In general, those people who wish to visit, study, or work temporarily in Canada must apply for a temporary resident visa (TRV). Depending on which country you are coming from, the application can be submitted either online or orally (at the time of your arrival at a port of entry (POA) to Canada).

Those who are coming by air from visa-exempt countries, such as Australia, Denmark, France, United States, and Japan, must obtain an electronic travel authorization (eTA) through IRCC website before entering Canada. Citizens of those countries do not require a TRV. Each accompanying family members of those visitors must apply separately for an eTA.

If your application for TRV, study or work permit, is refused, there is no right to appeal to the Immigration and Refugee Board (IRB). The only option is to seek permission for judicial review at the Federal Court, if the applicant believes that the refusal was discriminatory and not in a good faith.

There are four types of TRVs:

  • Single-entry visas: when the purpose of the entry is limited, such as participating in a conference for a short period of time.
  • Multiple-entry visas: when the entry to Canada will be more than once. These visas are valid for maximum of 10 years or the maximum validity of the length of the passport. However, the visitor cannot stay more than 6 months in each visit unless the officer fixes any other period of stay.
  • Transit visas: when people are travelling through Canada and they need a TRV. These foreign nationals can remain in Canada only up to 48 hours.
  • Parent and Grandparent Super visas: when parents or grandparents of a Canadian citizen or PR wish to visit Canada. The Super Visa is valid for 10 years or maximum validity of the passport. These visitors can have multiple entries and remain in Canada for up to two years at a time.

TRV holders should convince the officer they will leave Canada at the end the period authorized for their temporary stay.
