FAMILY CLASS

V-Land is pleased to offer you all the following services for sponsoring your loved ones.

The purpose of this class of immigration is to facilitate the reunification of the family members. Canadian citizens and permeant residents (PRs) can sponsor some certain categories of family members to Canada.

The following family members can be sponsored:

  • Spouses, common-law partners, and conjugal partners
  • Dependant children (either biological or adopted)
  • Parents and grandparents
  • Siblings, nephews, nieces, and grandchildren who are:
  • orphaned,
  • unmarried and do not have a common-law partner, and
  • under 18
  • Any relative, if the Canadian citizen or PR is alone in Canada with no family members and has any of the above-mentioned family members to sponsor.

Spouses, common-law partners, and conjugal partners

Type of relationship Required proof
Spouse Marriage must be legal and valid both in Canada and the country marriage took place Marriage certificate
Common-law Partner Have been living together in a conjugal relationship for at least one year continuously Same address and joint bank accounts, credit cards, leases, rental receipts, utilities, etc.
Conjugal Partner – Have been in a mutually interdependent relationship for at least one year, but could not marry or live together because of conditions beyond their control

– Foreign national is living outside Canada

Evidence showing:

– significant commitment to each other such as joint expenses or ownership of possessions

– obstacles they could not live together such as immigration barriers, marital status, sexual orientation, etc.

Dependent Children (biological or adopted)

As of October 2017, the government defined a dependent child as someone who is:

– under age 22 and single (unmarried and has no common-law partner)

– 22 years of age or older who has been financially dependant on a parent since before age 22 and is unable to be financially self-supporting because of having physical or mental disability.

The day the case processing center (CPC) receives your file (fully completed application and paid fees), the age of your child will be “frozen in time”. In other words, “lock-in” age will take effect from that day on and the length of the processing time will NOT affect it.

Parents and grandparents

You can sponsor your own parents and grandparents and their eligible dependants (spouse, partner, and children). IRCC will request the following information from them along with other documents:

– medical exams

– police certificates

– biometrics

Please keep the following important points in mind:

  • You can NOT sponsor your spouse’s parents and grandparents, but you can be a co-signer on your in-law’s application.
  • You can NOT sponsor anyone who is inadmissible to Canada.
  • If parents and grandparents want to stay in Canada less than 6 months, apply for a visitor visa.
  • You can also apply for Super Visa for your parents and grandparents, instead of sponsoring them to become a PR. Super Visa will allow them to stay in Canada up to 5 years at a time. It is a multi-entry visa for a period up to 10 years or the expiry date of their passports, whichever comes first.

Who can sponsor?

The sponsor must:

  • be at least 18 years old
  • be a Canadian citizen, permanent residents (PRs) or registered Indian
  • reside in Canada (If PRs are living abroad, they may not sponsor, but Canadian citizens may have a chance)
  • sign an undertaking to provide the basic needs of the sponsored person(s) and repay any government social assistance payments made to the sponsored person(s)
  • meet the Low-Income Cut-Off (LICO) level[1]:

– for Parents and Grandparents program, it is LICO + 30%[2] for three previous taxation years

– for spouse, common-law partner, or dependant children, the sponsor is exempt from the LICO test, i.e. the sponsor does NOT need to meet LICO level
